    ATOMIC ENERGY LICENSING (EXEMPTION) (IRRADIATING APPARATUS BELOW 5 KILO ELEKTRON VOLT) ORDER 2002

    1. Citation.
    This order may be cited as the Atomic Energy Licensing (Exemption) (Irradiating Apparatus Below 5 Kilo Elektron Volt) Order 2002.

    2.  Interpretation.

    In this Order, unless the context otherwise requires, "irradiating apparatus below 5 kilo elektron volt (keV)" means an irradiating apparatus which is capable of producing ionizing radiation that emits the maximum energy of 5 keV.



    3.  Exemption.

    Every person who has in his possession any of the irradiating apparatus below 5 keV is exempted from the provisions of the Act subject to the following conditions:



    (a) that the apparatus acquired the maximum energy which is capable of emitting or producing radiation not exceeding 5 keV;

    (b) that the apparatus is purchased from a seller who is licensed by the Board; and

    (c) that the person ensures that the apparatus can no longer function before he disposes of it.
