    Yahoo! Inc. V. Akash Arora case 
    Yahoo Incorporation is the owner of well-known trade mark, Yahoo and of the domain 
    name yahoo.com; both the trademark and the domain name acquired a distinctive name, 
    good will and reputation. Yahoo.com had been registered by Yahoo Inc. with Network 
    Solution Inc. since 1995 and offers a whole range of web based services. The trade mark 
    Yahoo had been registered in close to 69 countries. Yahoo Inc. had not registered its 
    domain name in India yet. Akash Arora had started offering web based services, which 
    are similar to those offered by Yahoo.com under the name of Yahoo India. Yahoo Inc. 
    sued Akash Arora for using a trade mark in a deceptive manner, similar to its own and 
    passing off his services as those offered by Yahoo Inc. 
    Encryption & digital signature 
    Transaction security is a major barrier to the development of e-commerce. Parties must 
    be able to use authentication techniques to ensure that the business conducted over the 
    networks need to be secured. The most dependable means is through cryptography i.e. 
    encryption and decryption. The most popular and useful method of encryption for general 
    messaging is public key cryptography. However cryptography could lead to threats to 
    national security, as more the level of encryption tougher it is for the national intelligence 
    agencies to keep a check on email and other exchanges over the internet. US has made 
    it a mandatory policy that encrypted software cannot be exported with more than 56 bit 
    encryption. Europe is in the process of developing policies or guideline for cryptography.
    Situation in India

    India at present does not have a law relating to regulation of encryption. The Department 
    of Telecommunication ("DoT") controls all aspects regarding Telecommunications, 
    including encryption. As of today, permission is required from the DoT to send encrypted 
    messages. The Indian government is in the process of developing a national encryption 
    policy that would facilitate e-commerce, and at the same time check cyber terrorism
