    Legal Issues in E Commerce

    Impact of technology on IPR
There is always a great concern regarding the originality of the product, plagiarism in
terms of content & duplication of other literary works. Thus lot of scope for improvement
of IPR exists even today. However, so far copyrights, trademarks & patents have been
extended to technological improvements through internet. So a trader, if registered could
claim possession of any emblem, designs, codes & software & other literary works. In
case of a conflict then the superior law between two countries taking into account the
larger good of the society will preside over.
    WIPO internet treaties
Though there were rules and regulations that were framed on the lines of protecting IPR
there was always a difference in interpretation of laws among different countries. With
the internet becoming ubiquitous it was necessary to address all the tech savvy issues so
that the customer benefits with such technological advancements. Thus nearly 100
countries took part in the conference & made an agreement. Therein international laws
were framed that would take care of any infringement to local, regional & national laws.
So in case of any conflict, the international law will automatically supersede and the final
decision should be agreed by the countries concerned.

    Contracts in E-Commerce
For a contract to be valid there has to be an offer, acceptance and valid consideration. In
an ecommerce business most of the
contracts are online, where the user of the website
‘clicks to accept’ the terms and conditions/ subscription / pricing and the like.
One of the premise of the Information Technology Act (IT Act) was to provide legal
recognition to electronic records and digital signatures, which in turn facilitates conclusion
of contracts and creation of legal rights and obligations through electronic communication.
    While the ‘offer’ and ‘consideration’
